Big News : The Revenue and Land Reforms Department has directed the officials to directly send the stubborn encroachers who are occupying public land to jail. The department has given this order in the context of those complaints, in which it is told that after the encroachment is freed, that land is re-occupied. After amendment in the Bihar Public Land Encroachment Act, provision has been made to give maximum punishment of one year to the encroachers. It is not used. This amendment took place in 2012. Earlier there was a provision of fine only.

Additional Chief Secretary Vivek Kumar Singh has written a letter to the Divisional Commissioners and District Magistrates asking them to make all types of public land encroachment free. For this, use the provisions of punishment made under the amendment in the Bihar Public Land Encroachment Act. This order of the department is in the context of encroachment-free public water bodies besides non-Majrua Mango, Khas, Kaiser Hind, Khas Mahal, land owned by government departments.

Discontent over encroachment on water bodies:

In 2015, the Patna High Court had ordered to make public water bodies encroachment-free in Rampunit Choudhary vs. State Government. Campaigns were launched on this front, but the water bodies were not completely encroachment free. In the last review meeting of the department, dissatisfaction was expressed over the situation of encroachment on water bodies. According to the Additional Chief Secretary – the achievement of some districts is good. However, the campaign for eradication of encroachment is not satisfactory in most of the districts.

Notice before action:

There is a provision to give notice to any trespasser before taking any punitive action. He will be asked to leave the land through a notice. If he is not freeing the land of his own free will then penal action will be initiated against him. In this he can be punished with fine up to jail.
